Our Commercial Property Team is part of our Company and Commercial Department providing specialist advice in relation to all aspects of the acquisition development and disposal of retail, leisure, office, warehouse, industrial and residential schemes, the financing of acquisitions and schemes and the implementation of joint ventures.

John Hepplestone and his team are all qualified Solicitors with many years experience in providing proactive and commercial advice. Our experience and expertise includes:

  • Joint Ventures
    From relatively straightforward partnering agreements through to corporate and limited liability partnership structures we are able to advise on the appropriate vehicle for achieving the desired commercial balance and reward, recognising the tax advantages which can be available and protecting the interests of the individual participants.
  • Finance
    We provide advice and guidance on the terms upon which finance is being provided, and on the security documentation to support the finance including charges upon the land, corporate and private individual guarantees and forward sales.
  • Site Acquisition
    We have detailed knowledge of options, conditional contracts (particularly related to planning permissions) auctions and tenders, both of a formal and informal/closed nature, provide assistance and advice on site assembly, as well as handling private treaty negotiations.
  • Site Development
    We assist in the negotiation and completion of planning obligations, whether by way of agreement or unilateral undertaking, to meet the requirements for the grant of planning permission, of infrastructure agreements, of the establishment of management companies and other structures to deal with communal facilities on any scheme and where appropriate the realisation of the reversionary value in a scheme (including the complexities of the Landlord & Tenant Act 1987 and related legislation).
  • Land and Unit Disposals
    We have far reaching experience in the preparation and negotiation of the documentation for freehold leasehold and commonhold unit disposals focusing upon maximising value for the developer, for the sale of land generally and particularly upon terms involving the payment of overage, with security for payment as and when the additional consideration arises, and the preservation of value in retained land, and for land exchanges between developers.
